Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of the Therapify platform, websites, and services (the "Platform") operated by Therapify Technologies Private Limited ("Therapify", "we", "us", or "our"), a company incorporated under the Companies Act, 2013, having its registered office at 9D, Building 2, Arnav Apartment, City Light Road, Umra, Surat – 395007, Gujarat, India (CIN: U62011GJ2026PTC178795). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Eligibility & accounts
- You must be at least 18 years old and capable of forming a binding contract to register.
- Practitioners represent that they hold the qualifications, registrations, and licences required to provide their services lawfully.
- You are responsible for the accuracy of your account information and for maintaining the confidentiality of your credentials. You are responsible for all activity under your account.
2. Roles of users
Practitioners and clinics use the Platform to manage their independent practice, including patient records, scheduling, and payments. They are solely responsible for the care they provide and for compliance with applicable professional, medical, and data-protection laws.
Patients/clients use the Platform to discover practitioners, book sessions, complete intake, attend telehealth, and make payments.
3. Acceptable use
You agree not to: (a) use the Platform for any unlawful purpose; (b) upload malicious code or attempt to disrupt or gain unauthorised access to the Platform; (c) misuse another user's data; (d) infringe intellectual property or privacy rights; (e) use the Platform to send spam or unsolicited communications; or (f) misrepresent your identity, qualifications, or authority.
4. Payments, platform fee & settlement
- Patient session fees are collected through the Platform via our payment partner (Cashfree Payments and/or other licensed payment service providers).
- Therapify charges a flat platform fee of 20% of each paid session fee. The remaining amount is settled to the practitioner's or clinic's linked bank account after the session is delivered, through the payment partner's split-settlement facility.
- Applicable Goods and Services Tax (GST) is charged on the platform fee and itemised on receipts.
- No platform fee is charged for unpaid bookings, cancellations, no-shows, or free intake calls.
- Settlement timelines are subject to the payment partner's processing schedules. Therapify does not act as a bank, and does not hold funds other than through the regulated facilities of its payment partner.
5. Refunds & cancellations
Cancellations, refunds, and rescheduling are governed by our Refund & Cancellation Policy, which forms part of these Terms.
6. Telehealth & clinical disclaimer
Telehealth sessions are hosted using third-party infrastructure. Therapify provides the technical means for sessions but is not responsible for the clinical content, quality, or outcome of any session. The Platform is not an emergency service. If you are experiencing a medical or mental-health emergency, contact your local emergency services immediately.
7. Third-party integrations
The Platform integrates with third-party services such as Google Calendar and Meta/Instagram. Your use of those integrations is also subject to the respective third party's terms. You authorise Therapify to act on your behalf only to the extent necessary to provide the features you enable (e.g. publishing social posts you compose). You may disconnect integrations at any time.
8. Intellectual property
The Platform, including its software, design, and content (excluding user-provided content), is owned by Therapify and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform in accordance with these Terms. You retain ownership of content you upload and grant us a licence to host and process it to provide the Platform.
9. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, or secure, and we make no warranties regarding any practitioner's services.
10. Limitation of liability
To the maximum extent permitted by law, Therapify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill. Our total aggregate liability arising out of or relating to the Platform shall not exceed the total platform fees paid to us by you in the three (3) months preceding the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold harmless Therapify and its directors, officers, and employees from any claims, damages, or expenses arising out of your use of the Platform, your content, or your breach of these Terms or applicable law. Practitioners additionally indemnify Therapify against claims relating to the care they provide.
12. Suspension & termination
We may suspend or terminate access for breach of these Terms, suspected fraud, or as required by law. You may close your account at any time. Provisions that by their nature should survive termination will survive.
13. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to any applicable arbitration agreement, the courts at Surat, Gujarat shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform.
14. Changes to these Terms
We may amend these Terms from time to time. Material changes will be notified through the Platform or by email, and continued use after changes take effect constitutes acceptance.
